Iran Inheritance and Estate Lawyer for Heirs Abroad

Inheritance work in Iran is not a single filing. The first task is to establish the deceased's legal and family status, identify the heirs and map the estate. The estate may include registered real property, bank deposits, company shares, vehicles, receivables and debts, and each category can require a separate court, registration, tax or administrative step.

For deaths registered under the current system, the Civil Registration Organization now has the statutory role of issuing the Iranian succession certificate (enhesar-e verasat). Under the implementing regulation, the certificate is prepared electronically within twenty days after registration of death on the basis of available official data; it is subject to an objection process before becoming final. Older deaths, incomplete family data, disputed parentage, missing heirs or an inability to issue the certificate may require a different application or court route.

The certificate identifies heirs and their shares, but it does not by itself collect, divide or sell every estate asset. Iranian law also requires estate liabilities and prior-ranking rights to be addressed before the heirs' ownership is fully settled. A lawyer should therefore separate heirship from debt review, preservation of assets, tax work, division, registration and any later sale.

Many stages can be coordinated from abroad through English-language intake, document review and an appropriately drafted power of attorney. Remote handling remains case-specific: a foreign death record, will, identity document or power of attorney may require translation, authentication, consular action or delivery of an original. Entitlement to an inheritance is also separate from banking, sanctions and international-transfer rules.
