Registration of an Iranian–Foreign Marriage in Iran

Marriage celebration, legal validity and registration in Iranian civil records are related but separate questions. The first review should identify each spouse's nationality, religion and civil status, where and how the marriage occurred, whether an Iranian marriage instrument exists, and what result is needed in Iran. A foreign certificate should not be assumed to update an Iranian shenasnameh automatically.

Article 1060 of the Civil Code provides that marriage of an Iranian woman to a foreign national requires special government permission even where no other legal impediment exists. The route for an Iranian man marrying a foreign woman is different. Other legal conditions, identity checks and document requirements may also apply, so the two procedures should not be presented as interchangeable.

Article 20 of the Family Protection Act requires registration of a permanent marriage. For Iranians abroad, the Ministry of Foreign Affairs provides marriage-registration services through Mikhak and the competent Iranian mission. Official instructions differ depending on the spouses' nationalities and the mission, and current appointment, original-document and civil-status requirements should be checked before submission.

A foreign marriage document may require certification, Persian translation and authentication. Name, birth-date, prior-marriage, divorce and nationality inconsistencies can block registration or create later problems for divorce, inheritance or a child's records. Legal review should precede document legalization when the underlying marriage or permission issue is uncertain.

The correct route depends on which spouse is Iranian, whether either spouse has another nationality, and whether previous marriages have been legally ended and recorded.

Article 1060 permission is a substantive requirement

An Iranian woman's marriage to a foreign national requires the special government permission stated in Article 1060. A foreign marriage certificate alone should not be assumed to cure a missing Iranian permission.

    Mikhak begins the overseas consular route

    The spouses generally submit the relevant request through Mikhak and follow the competent mission's current instructions. The file should be checked before appointments or mailing because the required originals and forms depend on the couple's circumstances.
